Who these terms are with
This website is operated by P+A Design L.L.C., an architecture, interior design and engineering consultancy licensed in the Emirate of Abu Dhabi, United Arab Emirates under trade licence No. CN-0000000, with its head office at Office 2nd Floor, Lamar Building, Al Nahyan Camp, Abu Dhabi, United Arab Emirates. The practice also maintains a studio at Via Roma 19, Cortina d’Ampezzo (BL), Italy.
In these terms, “we”, “us”, “our” and “the practice” mean P+A Design L.L.C. — and “you” means any person who visits this website or sends us an enquiry through it.
Accepting these terms
By visiting this website, using any part of it or submitting an enquiry through it, you accept these terms. If you do not accept them, please do not use the site.
We may update these terms from time to time. The version published on this page at the moment you use the site is the version that applies, and the date it was last changed is shown at the top of this page.
What this website is, and what it is not
This website describes the practice, the disciplines it holds in-house and a selection of completed and current work. It is published for general information.
Nothing on this website is architectural, engineering, planning, regulatory, financial or legal advice, and nothing on it should be relied on in place of a professional appointment. Guidance on authority approvals, building codes, climate response, cost or programme is written in general terms and cannot account for the specific plot, authority, budget or constraints of any particular project.
Enquiries do not create an appointment
Sending an enquiry, speaking to us, receiving a fee proposal or exchanging drawings for discussion does not create a contract of engagement, a duty of care or a client–consultant relationship.
The practice is appointed only when a written agreement identifying the scope of services, the project stages, the deliverables and the fee has been signed by both parties. Until that point no work is chargeable by us and none is owed to you.
Fee proposals and indicative information
Any figure, programme, stage duration or approval timeline mentioned on this website or in an initial reply to an enquiry is indicative only. It is based on the information given to us at that moment and does not bind either party.
Fee proposals are valid for the period stated in the proposal itself. Where no period is stated, a proposal lapses thirty (30) days after it is issued.
Intellectual property
All content on this website — including drawings, plans, renders, photographs, diagrams, text, the P+A Design name and logo, and the arrangement of the pages — is owned by the practice or used with the permission of the owner, and is protected under Federal Decree-Law No. 38 of 2021 on Copyright and Neighbouring Rights and by applicable international treaties.
You may view the site and print or download extracts for your own non-commercial reference. You may not reproduce, republish, adapt, distribute, sell or use any part of it commercially, and you may not use it to train an automated or machine-learning system, without our prior written consent.
Where a project appears on this site, intellectual property in the design remains with the practice unless a signed appointment says otherwise. Publication here is not a licence to build, copy or adapt the design.
How you may use this site
You agree to use this website lawfully and not to attempt to gain unauthorised access to it, disrupt it, introduce malicious code, scrape it by automated means, misrepresent your identity in an enquiry, or use it to send unlawful, defamatory or misleading material.
Misuse of an online service in the United Arab Emirates may be an offence under Federal Decree-Law No. 34 of 2021 on Countering Rumours and Cybercrimes. We will report suspected offences to the competent authorities and co-operate with them.
Project imagery and confidentiality
Some of the work shown on this site is published with the client’s consent, and some projects are not shown at all because that consent has not been given. Imagery may show design intent rather than the as-built condition, and visualisations are not photographs.
Where a project is identified by an area, a development or a building type rather than by a client name, that is deliberate and should not be treated as an invitation to identify the client.
Accuracy, availability and changes
We take reasonable care to keep this website accurate and current, but we do not warrant that it is complete, error-free or up to date, and codes, authority requirements and regulations change.
We do not warrant that the site will be available without interruption. We may change, suspend or withdraw any part of it, including any page or project, without notice.
Third-party links and content
This website may link to authority portals, standards bodies, suppliers or other third-party sites, and may embed third-party content such as a map. Those sites and services are not under our control.
A link is not an endorsement, and we accept no responsibility for third-party content, availability, terms or privacy practices. Read their terms before you rely on them.
Limitation of liability
To the fullest extent permitted by the applicable laws of the United Arab Emirates, the practice, its partners, directors and employees will not be liable for any loss or damage — including loss of profit, loss of opportunity, delay, or any indirect or consequential loss — arising out of your use of this website or your reliance on anything published on it.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under UAE law, including liability for death or personal injury caused by negligence, or for fraud.
Liability arising out of a project is governed by the signed appointment for that project and by the professional indemnity position recorded in it, not by this page.
Indemnity
You agree to indemnify the practice against any claim, loss, cost or expense arising out of your breach of these terms, your unlawful use of the site, or your unauthorised use of content taken from it.
Privacy and personal data
Personal data submitted through this website is handled in accordance with our Privacy Policy, which forms part of these terms and which explains how we collect, use, share, transfer and retain personal data under Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
Electronic communication
You agree that we may communicate with you electronically, and that electronic records, electronic signatures and email correspondence exchanged in connection with an enquiry or an appointment satisfy any legal requirement for writing, in line with Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services.
Consumer rights
Where you deal with us as a consumer within the meaning of Federal Law No. 15 of 2020 on Consumer Protection and its implementing regulations, nothing in these terms affects the rights that law gives you.
Events beyond reasonable control
We are not liable for any failure or delay caused by events beyond our reasonable control, including authority action or delay, changes in law or code, utility or network failure, extreme weather, epidemic, strike, or the act or omission of a third party we do not control.
Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or with this website, are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi.
The courts of Abu Dhabi have exclusive jurisdiction, save that where a dispute arises out of services contracted with and delivered by the Cortina d’Ampezzo studio, the parties may agree in the relevant appointment to submit that dispute to the competent Italian courts and to Italian law.
Where a signed project appointment specifies a different governing law, seat or dispute resolution procedure, that appointment prevails over this clause for that project.
Severability and waiver
If any clause of these terms is held to be invalid or unenforceable, the remaining clauses continue in force. A delay or failure by us to enforce any right is not a waiver of it.
